These terms and conditions (hereinafter ”Terms and Conditions”) apply to all purchases made by YOU on our website https://www.patatam.co.uk/ (hereinafter the "SITE").

These Terms and Conditions set out:
• YOUR legal rights and responsibilities;
• PATATAM’s legal rights and responsibilities; and
• certain key information required by law.

IMPORTANT
If YOU buy goods on our SITE, YOU agree to be legally bound by these Terms and Conditions. If YOU do not agree with or accept any of these Terms and Conditions, YOU should stop using the SITE immediately and not buy any goods on the SITE.

The following terms have the following meanings in these Terms and Conditions:
“ACCOUNT” means the interface inside which all data given by YOU is gathered, hosted on the SITE. Access to the ACCOUNT depends on YOUR CREDENTIALS.
“CONSUMER” means a person having the features of a consumer as defined in the Consumer Rights Act 2015 and is acting for purposes that are wholly or mainly outside his/her trade, business, craft or profession.
“CREDENTIALS” means the email address and the password necessary to access YOUR ACCOUNT on the SITE.
“DELIVERY” means the first presentation of the PRODUCTS YOU ordered at the address you provided when passing YOUR ORDER. “ORDER” means an order to purchase PRODUCTS which YOU make on the WEBSITE.
"PRODUCT” or “PRODUCTS" means all the clothes, shoes, bags and accessories for sale on the SITE. Except where otherwise mentioned all PRODUCTS referenced on the WEBSITE are second-hand goods.

"TERRITORY" means the United Kingdom or UK.
“YOU/YOUR” means the person using our SITE to place an ORDER to buy PRODUCTS from PATATAM and being a consumer as defined in the Consumer Rights Act 2015. As such, YOU must be acting as a CONSUMER.

Acceptance

YOU agree to read these Terms and Conditions carefully and to accept them before proceeding to payment of an ORDER of PRODUCTS on the SITE.

These Terms and Conditions are referenced at the bottom of each page of the SITE by means of a link and they may be updated or modified in accordance with Article 19. The latest version of the Terms and Conditions applies to any new ORDER of PRODUCTS. YOU must read through and accept the latest version of the Terms and Conditions before placing an ORDER. YOU are encouraged to carefully read, download, and print the Terms and Conditions and to keep a copy for YOUR records.

The acceptance of these TERMS AND CONDITIONS takes the form of a checkbox YOU must tick when you place your ORDER.

By clicking on the button to place an ORDER and then the button to confirm the ORDER, YOU acknowledge having read, understood and accepted these Terms and Conditions without limitations or conditions.

Purchasing on Patatam

. Nature of Goods :

The Consumer Rights Act 2015 gives YOU certain legal rights (also known as ‘statutory rights’), for example, the goods:
• are of satisfactory quality;
• are fit for purpose;
• match the description, sample or model; and
• are installed properly (if PATATAM installs any goods).
PATATAM must provide YOU with PRODUCTS that comply with YOUR legal rights.
The packaging of the PRODUCTS may be different from that shown on the SITE.
While PATATAM tries to make sure that:
• all weights, sizes and measurements set out on the SITE are as accurate as possible, there may be a small tolerance of variation in such weights, sizes and measurements certain PRODUCTS; and
• the colours of the PRODUCTS are displayed accurately on the SITE but the actual colours that YOU see on YOUR computer may vary depending on the monitor that YOU use.
Any PRODUCTS sold:
• at discount prices;
• as remnants; or
• as substandard
will be identified and sold as such. Please check that they are of a satisfactory quality for their intended use before YOU place an ORDER for such PRODUCTS.
If WE can’t supply certain PRODUCTS WE may need to substitute them with alternative goods of equal or better standard and value. In this case:
• PATATAM will let YOU know if PATATAM intends to do this but this may not always be possible; and
• YOU can refuse to accept such substitutes, in which case PATATAM will offer YOU a refund or a replacement and let YOU know how long such an offer remains open for.
. Pricing policy :

Prices of the PRODUCTS including the applicable delivery charges (depending on the weight of the package, excluding packaging and gifts, the delivery address and the carrier and method of delivery) are available from the SITE and are in Pound Sterling (GBP or £).
Prices include, in particular, value added tax (“VAT”) at the rate in force on the date of the ORDER. Any changes in the applicable rate may impact the price of the PRODUCTS from the effective date of the new rate.
The applicable VAT rate is expressed as a percentage of the value of the PRODUCT sold.
The prices shown on the SITE may change in cases of special offers or sales.
The prices quoted on the SITE are valid, unless there is a gross error. The applicable price is that indicated on the SITE on the date YOUR place the ORDER.

. Order :

Once YOU have selected a PRODUCT and placed it in YOUR shopping basket, YOU must click on the shopping basket to ensure the contents of YOUR ORDER are correct. If YOU have not done so, PATATAM will invite YOU to identify YOURSELF or register.
If YOU confirm the contents in the shopping basket and have identified or registered on PATATAM SITE, an automatically completed online form will appear summarising the price and, if applicable, the delivery charges.
YOU may select the delivery method for YOUR ORDER between the following:
- Express Delivery
- Standard Delivery
If applicable, YOU may enter your promo code. No free delivery code may be entered.
By clicking on “Next”, YOU can enter the delivery address.
After clicking “Save”, YOU will be asked to verify the details of YOUR ORDER (including the quantity, characteristics and references of the ordered PRODUCT, the billing address, the means of payment and the price).
At this stage, YOU can select your method of payment.
After reading and agreeing to these TERMS AND CONDITIONS, YOU can select “I confirm my ORDER”.
Once verified, YOU can then proceed to payment of the PRODUCTS following the instructions on the SITE and by providing all the information necessary for the invoice and the delivery of the PRODUCTS. If options are available for the PRODUCT, specific references will appear when the correct option(s) have been selected. YOU must include all the information required for the correct processing of the ORDER.

. Deliveries :

The delivery of your order will be made to the stipulated location. The order will be delivered either to a local commerce through our associates Royal Mail or by post to the address indicated on the order form.

Royal Mail generally deliver to all points within the UK within a 72 hour time frame from the time the package is turned in to the delivery agency by Patatam.

Express Delivery – Royal Mail, Delivery is expected in 1 to 3 days of despatch.
Standard Delivery – Royal Mail, Delivery is expected in 3 to 5 days from despatch.

For any package delivered to a home, place of work or any address provided by the client (not including official delivery locations) it is the recipient's responsibility to make sure that the package is delivered personally or to a safe letter box. Patatam will consider any package deemed "delivered" by the transporter to be free of any legal claims concerning wrongful delivery.
It is also the responsibility of the client to verify the state of the item upon reception. Patatam pays extreme attention to the packaging of the product in order to assure a safe delivery. If the client finds a fault in the packaging upon delivery, it is their responsibility to notify the transporter of this event. Patatam will support the client in this process but cannot be held liable in the case of a product damaged during transport.

In the event of the absence of the recipient, a notice of attempted delivery will be left in the letter box by Royal Mail, stating when and where to retrieve the package. Your package will be safely kept at the local Post Office according to the information provided on the notice.

For deliveries through Royal Mail, please refer to the following guidelines : https://www.royalmail.com/terms-and-conditions/.Please pay special attention to the point concerning the delivery locations : « Packages are available for their retrieval for a period of 14 days, after which the package will be returned to the sender ».

In the event that the package is not retrieved from the delivery location within the 14 days allowed by Royal Mail, the package will be returned to Patatam, who reserves the right to reimburse the price of the products. The shipping charges will be covered by the client. If the free shipping option was used, Patatam reserves the right to charge a retainer of £3.90 off of the reimbursement of the items in order to cover the costs of the processing of your package from the delivery location to the warehouses of Patatam.

In the case of an unusually long delay in the delivery of the package, Royal Mail must be contacted in order to clarify the situation. If need be, Patatam may be contacted by e-mail in order to help locate the package.

The exceeding of the delivery period does not allow for any type of discounts or reimbursements nor cancellation of orders. This includes reasons such as partial or total strikes, either inside or outside of the company, transportation or supply restrictions and/or legal or government issues.

. Returning items :

If YOU cancel this contract, PATATAM will reimburse to YOU all payments received from YOU, including the costs of delivery (except for the supplementary costs arising if YOU chose a type of delivery other than the least expensive type of standard delivery offered by US). WE will make the reimbursement without undue delay, and not later than - 14 days after the day WE received back from YOU any goods supplied; or - (if earlier) 14 days after the day YOU provide evidence that YOU have returned the PRODUCT to US; or - if there were no goods supplied (i.e. only services are supplied), 14 days after the day on which WE are informed about YOUR decision to cancel this contract. PATATAM will make the reimbursement using the same means of payment as YOU used for the initial transaction, unless YOU have expressly agreed otherwise; in any event, YOU will not incur any fees as a result of the reimbursement. Return policy YOU must return the PRODUCT to PATATAM at the address: PATATAM UK Operations Centre, 2b Centurion Business Park, Sturrock Way, Peterborough. PE3 - without undue delay and no later than fourteen (14) days after notifying PATATAM of YOUR decision to cancel YOUR ORDER. Return fees PATATAM may bear the direct costs of returning the PRODUCT only if the return is made through Royal Mail.
If the return is made by any other carrier than Royal Mail, YOU will have to bear the direct costs of returning the PRODUCT. In the event that, due to its weight, the PRODUCT, cannot be returned through Royal Mail, YOU will have to bear the direct costs of returning the PRODUCT by another mean.

Condition of the property returned
The PRODUCT must be returned according to PATATAM’s instructions and must include all accessories delivered. YOU are liable for any diminished value of the PRODUCT resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the Goods.

Exclusions from the right of cancellation

The right of cancellation is excluded in the following cases:
- Supply of goods or services of which price depends on fluctuations in the financial market
- Supply of goods made according to YOUR specifications or that are clearly personalised
- Supply of goods liable to deteriorate or to perish rapidly
- Provision of audio or video recordings or sealed software that have been unsealed after delivery
- Journal, periodical, magazine (except subscription contract)
- Provision of accommodation services other than for residential purposes, transportation of goods, car rentals, restaurants or recreational services if the offer provides a specific date or a period of performance
- Supply of goods which by their nature are indissociably connected to other goods
- Supplies of sealed goods that cannot be returned for health or hygiene reasons and that YOU have unsealed the goods after delivery.
- Supply of alcoholic beverages, the price of which had been agreed at the time of conclusion of the contract of sale, the delivery can only be made after 30 days and the actual value of which depends on fluctuations in the market beyond OUR control
- Provision of non-dematerialised digital content if execution has started with YOUR express prior consent, with YOUR acknowledgment that YOU will lose YOUR right of cancellation
- Contracts concluded at a public auction
. Cancellation :

Principle of cancellation
YOU have the right to cancel YOUR ORDER by returning the PRODUCT to PATATAM. To this end, the PRODUCT must be returned to PATATAM without undue delay and no later than fourteen (14) days after notification of YOUR decision to cancel.

Cancellation period
The cancellation period will expire after fourteen (14) days from the day YOU or a third party designated by YOU, excluding couriers, takes physical possession of the PRODUCT. If YOU have ordered several PRODUCTS by a single ORDER leading to several deliveries (or several badges of delivery for one PRODUCT), the cancelation period expires fourteen (14) days from the day YOU or a third party designated by YOU (excluding carriers) takes physical possession of the last delivery of the PRODUCT(S).
Notification of right of cancellation
To exercise YOUR right to cancel, YOU must inform PATATAM of YOUR decision to cancel this contract by a clear statement (e.g. a letter sent by post or email): to PATATAM UK Operations Centre, 2b Centurion Business Park, Sturrock Way, Peterborough. PE3 8YF or [email protected].

To exercise YOUR right to cancel, YOU may access your ACCOUNT, under the “my ORDER” entry YOU must select “Detail” and then “Return” to generate a return voucher. YOU must stick this voucher to the package to get a free return by dropping the package to the pickup point of our partner.

Personal data

PATATAM collects YOUR personal data on the SITE, including via Cookies. YOU can disable the cookies by following the guidelines given by your browser. The data collected by PATATAM are used in order to process the ORDERS made on the SITE, manage YOUR account, analyse the ORDERS and, if YOU have specifically chosen this option, send YOU commercial solicitation mails, newsletters, promotional offers and/or information on special sales, except if YOU do not wish to receive such communications from PATATAM. YOUR data are confidentially stored by PATATAM, per the needs of the contract, its execution and in compliance with the law.
YOU can unsubscribe at any time by accessing your ACCOUNT or clicking on the hyperlink, for this purpose, at the bottom of any offer received via email.

Data can be communicated, totally or partially, to PATATAM’s services providers intervening in the ORDER process.

PATATAM shall specifically ask YOU if YOU wish for your personal data to be disclosed. YOU can change your mind at any time by reaching PATATAM. PATATAM can also ask YOU if YOU wish to receive commercial solicitations from its partners.

In accordance with the regulation (EU) 2016/679 of the European Parliament and of the Council of April 27th 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation also known as GDPR), PATATAM insures the enforcement of the rights of the people concerned.
It should be reminded that, when YOUR personal data are processed, YOU get rights regarding access, rectification, update, portability and deletion of the information concerning YOU in accordance with the provisions of articles 15, 16 and 17 of the General Data Protection Regulation (GDPR).

In accordance with the provisions of article 21 of the GDPR, YOU can, with legitimate reasons, oppose the processing of YOUR personal data without costs or motive.
